Mariana Antonovych is a Managing Associate with AVELLUM’s dispute resolution practice with a special focus on the settlement of complex multijurisdictional disputes in the national courts (e.g., Cyprus, Belize, Switzerland, Liechtenstein, BVI, UK) and under the procedures of international commercial and investment arbitration. Mariana represents clients in arbitration proceedings under various arbitration rules such as LCIA, ICC, SCC, UNCITRAL etc.

Mariana represents clients’ interests in litigation proceedings involving assets tracing and fraud investigations. She also advises on proceedings in Ukraine on recognition of foreign court orders and awards.

Prior to joining AVELLUM Mariana worked at Kyiv office of international law firm.

      Representing Respondent in a USD4.6 billion investment treaty arbitration under the UNCITRAL Arbitration Rules arising out of alleged investments into a major Ukrainian aerospace company

      Representing Respondent in a USD3.2 billion investment treaty arbitration under the SCC Arbitration Rules arising out of alleged investments into a major Ukrainian bank

      Representing a leading Ukrainian agriculture company in an LCIA arbitration arising out of a failed joint venture

      Advising an Australia-based graphite producer and gold exploration company in relation to potential LCIA arbitration over alleged breach of the SPA

      Represented the client in the proceedings before the UK High Court with regard to the challenge of an LCIA award

      Represented the client in a USD20 million LCIA arbitration in a large multijurisdictional shareholders’ dispute with parallel court proceedings in Panama, Cyprus, Liechtenstein, Switzerland, Belize and the UK

      Represented a global game development company in an arbitration over a game development agreement under the IFTA Rules with USD1 million in dispute

      Represented the client in an LCIA arbitration in a post-M&A dispute related to the sale of one of the largest agro holdings in Ukraine for alleged breach of the SPA

      Assisted in preparation of an expert report on Ukrainian law in an investment dispute before the PCA

      Assisted in preparation of an expert report on Ukrainian law in a commercial dispute before the UK High Court (see Avonwick Holdings Ltd v Azitio Holdings Ltd & Ors [2020] EWHC 1844 (Comm) (14 July 2020))

      Advised the client in connection with the litigation in London relating to family law matters and related proceedings on recognition of the English court orders in Ukraine

      Advised the state-owned aviation company in Ukraine in relation to elaborating a strategy in the ICC arbitration under a claim against client's contractor

      Advised the Ukrainian state-owned enterprise which specialises in export and import activity on the world market of military and dual-purpose products and services, in relation to elaborating a defence strategy under a potential SCAI claim

      Represented Cyprus company, as a respondent, in the pending Cypriot court proceedings on recognition and enforcement of the award of the International Commercial Arbitration Court at the International Chamber of Commerce and Industry of Ukraine

AVELLUM DEFEATS USD20 MILLION CLAIM IN AN “EXCEPTIONALLY HARD-FOUGHT” LCIA ARBITRATION

AVELLUM defeated a USD20 million claim in an “exceptionally hard-fought” LCIA arbitration. In a detailed Award issued in June 2021, the LCIA Tribunal dismissed claims against the client of AVELLUM, finding fraud and dishonesty on the claimant’s side.

AVELLUM defeated a USD20 million claim in an “exceptionally hard-fought” LCIA arbitration. In a detailed Award issued in June 2021, the LCIA Tribunal dismissed claims against the client of AVELLUM, finding fraud and dishonesty on the claimant’s side. The arbitration is part of a multi-hundred million US Dollars shareholders dispute with parallel litigation proceedings in 6 jurisdictions. At the final virtual hearing, AVELLUM cross-examined over two dozens of the claimant’s witnesses of fact, whilst the hearing bundles included thousands of documents dating back to late 1990s. Kostiantyn Likarchuk, a senior partner, commented: “The Tribunal characterised this arbitration as exceptionally hard-fought with the most serious accusations advanced on both sides. We are pleased to have prevailed in this complicated legal battle, which covered almost all conceivable arbitration-specific topics, including the bifurcation of proceedings, security for costs, disclosure from third parties, forensic examination and claims of legal professional privilege pertaining to evidence, as well as various matters as regards the Tribunal’s jurisdiction. This case is exemplary of justice ultimately prevailing if being fought for with determination.” AVELLUM team in this arbitration was led by senior partner Kostiantyn Likarchuk with significant support from counsel Mykyta Nota, senior associates Mariana Antonovych and Oleksii Maslov, and associate Anna Vlasenko.
