AVELLUM successful for the client before the High Anticorruption Court

AVELLUM defended the client, a Member of Parliament of Ukraine of the 9th convocation, a Lieutenant General of the Ukrainian Armed Forces, in the criminal case heard by the High Anticorruption Court.

The National Anticorruption Bureau of Ukraine investigated the criminal case under the supervision of the Specialised Anticorruption Prosecutor’s Office for about two years.

Our client was charged under Article 366-2 of the Criminal Code of Ukraine. The prosecutor argued that the client violated the provisions of Ukrainian anticorruption law relating to financial control. In particular, the client was accused of willful failure to disclose his property in the annual public declaration.

In March 2023, the High Anticorruption Court granted the defence application and closed the case.

In addition, AVELLUM challenged the decision of the National Agency for Corruption Prevention in the administrative court. This decision served as a trigger to launch the criminal case. As of today, the administrative claim is being heard by the Supreme Court and promises to become precedent-setting in this category of disputes.
