AVELLUM and Hillmont Partners successfully defended US investors, stopping an attempted corporate raid

The Anti-Raiding Office of the Ministry of Justice of Ukraine has satisfied the complaint filed by Hillmont Partners on behalf of its client, Madison Pacific Trust Limited. Madison Pacific Trust Limited represents the interests of Argentem Creek, a US-based lender. The complaint concerned the cancellation of an unlawful registration action to change the head of Olympex Coupe International.

In May 2024, the state registrar, contrary to the decision of the Western Commercial Court of Appeal of April 2024 to entrust the insolvency receiver with the duties of the head of Olympex Coupe International, violated the ruling by performing a registration action by which he changed the head of the company to a person close to the former owners of GNT Group.

AVELLUM and Hillmont Partners jointly prepared the evidence base and developed a legal position on the unlawfulness of this registration action. The team proved that the registration action was taken in flagrant violation of Ukrainian law and international treaties. It stopped another attempt of the former business owners’ raider seizure of GNT Group.

AVELLUM team was led by senior partner Konstantin Likarchuk and partner Vadim Medvedev, supported by managing associate Oleksandra Syerova and senior associate Kristina Mysenko. Hillmont Partners was represented by senior partners Valentyn Zasukha and Andriy Nyzhnyi, counsel Oleksiy Myagkyi and senior associate Bohdan Novyk
