We are pleased to announce that AVELLUM lawyers participated in developing the Recommendations on Ensuring Due Process Standards in Claims Against the russian federation (“Recommendations”).
The Recommendations are the result of two years of research into the practice of Ukrainian courts, international standards of due process and foreign legislation by a working group of the Ukrainian Arbitration Association, which included AVELLUM lawyers, and the Institute of Legislative Ideas.
On 20 September 2024, Oleksii Maslov, Counsel of Dispute Resolution Practice at AVELLUM and Member of the Board of the Ukrainian Arbitration Association presented the Recommendations at the Supreme Court during the conference “Ensuring Uniformity of Court Practice in War-Related Cases”, organised by the Supreme Court in cooperation with the OSCE Support Programme for Ukraine.
The Recommendations highlight distinct procedural features of cases against the russian federation, considering its legal status as a foreign state. The authors propose best practices for courts and litigants aimed at complying with due process standards and increasing the chances of the eventual enforcement of judgments against the aggressor state in foreign jurisdictions.
We also hope that the Recommendations will facilitate further discussion of the relevant issues among the broad set of stakeholders.
