Information

Oleksii Maslov is a Counsel with AVELLUM’s dispute resolution practice. Oleksii primarily focuses on international arbitration and cross-border litigation, including international commercial and investment arbitration, as well as complex negotiations. Oleksii has strong expertise in M&A transactions and corporate law.

Oleksii regularly advises and represents international and Ukrainian clients in high-profile arbitrations under the Rules of the ICC, LCIA, ICSID, UNCITRAL and ICAC at the Ukrainian Chamber of Commerce and Industry. He also advises clients on complex cross-border litigations, involving such jurisdictions as Cyprus, the BVI, the UK and Ukraine. His recent experience includes representing an international investment company in a LCIA arbitration, advising Czech industrial manufacturer in 4 simultaneous arbitrations before the ICAC at UCI and advising large group of investors on a potential investment claim.

Oleksii is an active member of Ukrainian arbitration community and regularly participates in preparation of amicus curiae briefs for Ukrainian courts.

Prior to joining AVELLUM Oleksii worked with another leading Ukrainian law firm.

AVELLUM defeated a USD20 million claim in an “exceptionally hard-fought” LCIA arbitration. In a detailed Award issued in June 2021, the LCIA Tribunal dismissed claims against the client of AVELLUM, finding fraud and dishonesty on the claimant’s side. The arbitration is part of a multi-hundred million US Dollars shareholders dispute with parallel litigation proceedings in 6 jurisdictions. At the final virtual hearing, AVELLUM cross-examined over two dozens of the claimant’s witnesses of fact, whilst the hearing bundles included thousands of documents dating back to late 1990s. Kostiantyn Likarchuk, a senior partner, commented: “The Tribunal characterised this arbitration as exceptionally hard-fought with the most serious accusations advanced on both sides. We are pleased to have prevailed in this complicated legal battle, which covered almost all conceivable arbitration-specific topics, including the bifurcation of proceedings, security for costs, disclosure from third parties, forensic examination and claims of legal professional privilege pertaining to evidence, as well as various matters as regards the Tribunal’s jurisdiction. This case is exemplary of justice ultimately prevailing if being fought for with determination.” AVELLUM team in this arbitration was led by senior partner Kostiantyn Likarchuk with significant support from counsel Mykyta Nota, senior associates Mariana Antonovych and Oleksii Maslov, and associate Anna Vlasenko.

AVELLUM AND AGA PARTNERS SUCCESSFULLY REPRESENTED MAJOR MINING MACHINERY PRODUCER IN FOUR DISPUTES BEFORE ICAC

After a year of proceedings, the arbitral tribunals in each of the cases took into account the presented evidence and satisfied our Client’s claim covering a total of more than EUR4 million, including interest, arbitration fees, and legal costs.

AVELLUM jointly with AGA Partners successfully represented a major CEE-based mining machinery producer in four disputes with a Hong Kong company before the ICAC at the Ukrainian Chamber of Commerce and Industry. The disputes arose under four separate contracts for the supply of mining machinery and equipment to Ukraine amounting to a total of almost EUR6 million. Our client has duly fulfilled its contractual obligations under the contracts, but the respondent did not pay the full price for the delivered goods. The total amount of debt owed to our Client was over EUR4 million. Mykola Stetsenko, managing partner of AVELLUM, commented: “This case was challenging. First of all, our team managed four separate arbitral proceedings, including two sets of simultaneous hearings. Secondly, the respondent alleged that our client’s claims are time-barred and should be dismissed. The seamless interaction within our joint team and the right set of skills and expertise added to resolving this matter successfully.” Ivan Kasynyuk, partner of AGA Partners, noted: “Following the respondent’s allegations, we have provided the arbitral tribunals with various evidence demonstrating that the respondent, in fact, had acknowledged the debt under the contracts several times. Our lawyers convinced the tribunal in admissibility and relevance of the evidence and proved that this evidence indicated the interruption of the limitation period under Ukrainian law and, accordingly, the claims of our client can be considered in arbitration.” After more than one year of proceedings, the arbitral tribunals in each of the cases took into account the presented evidence and satisfied our Client’s claim covering a total of more than EUR4 million, including interest (3% per annum), arbitration fees, and legal costs.
