New Law to accelerate industrial reconstruction in Ukraine

On 28 May 2024, Law “On Amendments to Certain Legislative Acts of Ukraine to Simplify the Procedure for Changing the Designated Use of Land Plots to Attract Investments for the Rapid Reconstruction of Ukraine” No. 3563- IX (“Law”) will come into force.

The Law enhances the conditions for reconstructing industrial facilities destroyed or damaged by russia’s military aggression.

In particular, the Law:

  • simplifies the procedure for changing the designated use of land plots outside the cities where there is no town-planning documentation for land owners and users who plan to accommodate industrial and energy facilities on such land plots. During the martial law period and five years after it’s lifted, changing the designated use of such plots will be allowed based on a reasoned conclusion of the local urban planning and architecture authority;
  • expands during the martial law period and six months after it’s lifted the list of financing sources for the development of detailed plans of territories for placing energy facilities;
  • abolishes the requirement to obtain a decision from the Ministry for Restoration for placing new and expanding existing multimodal terminals, production-loading complexes, and river ports (terminals).

We are optimistic that the Law will accelerate the implementation of investment projects to reconstruct Ukraine.
