AVELLUM successful in recognition and enforcement of an arbitral award

AVELLUM successfully represented an international educational loans provider in the Ukrainian court proceedings on recognition and enforcement of an LCIA Award.

This matter was important due to unique legal issues raised in it that were critical for the development of pro-arbitration court practice in Ukraine. Among others, those include arbitrability of disputes with consumers and, generally, law applicable to deciding arbitrability defence under Ukrainian law and the New York Convention.

Despite some prior negative court practice, our team developed convincing argumentation and secured recognition of the Award in the first instance court, which was upheld by the Supreme Court.
