Anna Vlasenko is a Senior Associate with AVELLUM’s dispute resolution practice.

Anna’s practice primarily focuses on international commercial and investor-state arbitration. Anna’s recent experience includes advising and representing clients in high-profile arbitration proceedings under various arbitration rules, including the Rules of the SCC, UNCITRAL, LCIA and ICAC at the Ukrainian Chamber of Commerce and Industry. As part of her practice, Anna also regularly advises clients on various aspects of complicated cross-border disputes, involving jurisdictions of the UK, Canada, Cyprus, the BVI, and Liechtenstein.

Anna has broad experience in representing clients in complicated disputes before Ukrainian courts, including the Supreme Court. In addition to that, Anna has strong expertise in insolvency proceedings. Her portfolio includes representing international and domestic creditors in a number of large-scale insolvency proceedings.

Anna regularly contributes to Ukrainian arbitration community, including through preparation of amicus curiae briefs for the Supreme Court.

Since 2022 Anna is also an associate on secondment with Debevoise & Plimpton London.

      Successfully defeated a USD20 million claim in an “exceptionally hard-fought” LCIA arbitration, being a part of a multi-hundred million US Dollars shareholders dispute with parallel litigation proceedings in 6 jurisdictions

      Represented Ukrainian subsidiary of LSE-listed Ferrexpo Plc in a dispute against Ukrainian Bank “Finance and Credit” undergoing liquidation. The dispute arose out of the failure of the bank to carry out the client’s payment instructions resulting in the USD10 million losses

      Represented world leading investment funds as owners of majority of notes issued by Mriya Agro Holding plc in the debt recovery proceedings against almost 70 surety providers before the Ukrainian courts

      Represented world leading investment funds as owners of majority of notes issued by Mriya Agro Holding plc in a number of insolvency proceedings of Mriya group companies before the Ukrainian courts

      Represented Česká exportní banka, a. s. in a set of litigations before Ukrainian commercial and administrative courts against the Ukrainian borrower and local municipal authorities aimed at reinstatement of the Bank's rights under the mortgage agreements, as well as opposing attempts by the Ukrainian borrower to dissipate the mortgaged and pledged assets

      Represented Česká exportní banka, a. s. in a set of litigations before general, commercial and administrative courts arising out of the enforcement of the Bank's claims against the mortgaged and pledged assets of the Ukrainian borrower

      Advised the client on various aspects of corporate, labour and contractual law in an over USD30 million dispute at the High Court of Justice

      Advised the major German industrial group in a dispute (Stockholm-seated arbitration under the ICC rules) with its international customer in relation to operation of sophisticated industrial equipment

      Advised a UK investor on recovery of debt from Ukrainian borrower and surety providers, as well as recognition and enforcement of the UK court judgments and freezing orders in Ukraine

      Advised on points of Ukrainian law within the USD 1 billion litigation before the English High Court of Justice relating to the dispute arising out of division of interests in the Ukrainian businesses

      Advised Poltava Petroleum Company, Ukrainian subsidiary of the LSE-listed JKX Oil & Gas plc, on a range of issues related to tax and criminal matters

      Advised a large European bank regarding the recovery of debt from the group of companies that owns a network of petrol stations in Ukraine

      Represented Eurohold Bulgaria Plc (one of the leading Bulgarian financial services companies, which is running its businesses across Europe) before Ukrainian courts in a set of litigations initiated by the former director of its Ukrainian subsidiary

      Represented Yeristovo Mining in court proceedings against the Ukrainian tax authorities. Yeristovo Mining challenged an individual tax ruling concerning the basis of assessment of rental payments for subsoil use

AVELLUM defeated a USD20 million claim in an “exceptionally hard-fought” LCIA arbitration. In a detailed Award issued in June 2021, the LCIA Tribunal dismissed claims against the client of AVELLUM, finding fraud and dishonesty on the claimant’s side. The arbitration is part of a multi-hundred million US Dollars shareholders dispute with parallel litigation proceedings in 6 jurisdictions. At the final virtual hearing, AVELLUM cross-examined over two dozens of the claimant’s witnesses of fact, whilst the hearing bundles included thousands of documents dating back to late 1990s. Kostiantyn Likarchuk, a senior partner, commented: “The Tribunal characterised this arbitration as exceptionally hard-fought with the most serious accusations advanced on both sides. We are pleased to have prevailed in this complicated legal battle, which covered almost all conceivable arbitration-specific topics, including the bifurcation of proceedings, security for costs, disclosure from third parties, forensic examination and claims of legal professional privilege pertaining to evidence, as well as various matters as regards the Tribunal’s jurisdiction. This case is exemplary of justice ultimately prevailing if being fought for with determination.” AVELLUM team in this arbitration was led by senior partner Kostiantyn Likarchuk with significant support from counsel Mykyta Nota, senior associates Mariana Antonovych and Oleksii Maslov, and associate Anna Vlasenko.
